TN Visa for Canadians Seeking Work In the US

Navigating the pathway to employment in the United States can be a complex endeavor for Canadian professionals. This visa category allows qualified Canadian professionals to work in the U.S. in specific occupations without the need for a traditional work visa.

Understanding the TN Visa

The TN visa is a non-immigrant classification that permits Canadian and Mexican citizens to work in the U.S. in prearranged business activities for U.S. or foreign employers. It's important to note that this provision is exclusive to citizens; permanent residents of Canada or Mexico are not eligible for the TN visa. 

Eligible Professions

The USMCA outlines a comprehensive list of professions eligible for TN status. These professions span various fields, each with specific educational and professional requirements. Below is an overview of some of the key categories and examples of professions within each:

  • General Professions: Accountant, Architect, Computer Systems Analyst, Economist, Engineer, Graphic Designer, Librarian, Management Consultant.

  • Medical and Allied Professionals: Dentist, Dietitian, Medical Laboratory Technologist, Occupational Therapist, Pharmacist, Physician (teaching or research only), Physiotherapist/Physical Therapist, Psychologist, Registered Nurse, Veterinarian.

  • Scientists: Agriculturist (including Agronomist), Animal Breeder, Biochemist, Biologist, Chemist, Geologist, Geophysicist, Meteorologist, Pharmacologist, Physicist, Zoologist.

  • Teachers: College, Seminary, University.

Each profession has specific criteria regarding education and, in some cases, licensing. For instance, an Architect must possess a Baccalaureate or Licenciatura Degree or a state/provincial license. Similarly, a Computer Systems Analyst requires a Baccalaureate or Licenciatura Degree, or a Post-Secondary Diploma or Certificate along with three years of experience. 

Application Process for Canadian Citizens

One of the advantages for Canadian citizens is the ability to apply for TN status directly at a U.S. port of entry, eliminating the need to obtain a TN visa beforehand. The general steps include:

  1. Job Offer: Secure a job offer from a U.S. employer in an eligible profession.

  2. Documentation Preparation: Gather the necessary documentation, including:

    • Proof of Canadian Citizenship: Such as a valid passport.

    • Employment Letter: A detailed offer letter from the U.S. employer outlining the professional capacity in which you'll work, the purpose of employment, length of stay, and educational qualifications.

    • Educational Credentials: Originals or certified copies of relevant degrees, diplomas, licenses, or certificates.

  3. Port of Entry Application: Present the documentation at a U.S. port of entry or a designated pre-clearance/pre-flight inspection station. The U.S. Customs and Border Protection (CBP) officer will assess the application and make an immediate determination.

Key Considerations

  • Temporary Intent: The TN visa is for temporary employment. Applicants must demonstrate that their stay in the U.S. is temporary, without the intention of permanent residence.

  • Duration and Renewal: TN status is granted for up to three years and can be renewed indefinitely, provided the temporary nature of employment is maintained.

  • Dependents: Spouses and unmarried children under 21 can accompany the TN visa holder under TD status. While they can study in the U.S., they are not permitted to work.
